Wachovia Admits It Laundered Millions in Mexican Drug Cash

Wachovia bank executives have admitted that the banking giant laundered millions of dollars for Mexican drug lords between 2003 and 2008, prosecutors announced in Miami this afternoon.

The bank has promised to pay $160 million in fines and penalties and to set up new safeguards within a year to prevent drug money from coming through the bank.

If it fails in that effort, Wachovia could face criminal charges, says Jeffrey Sloman, U.S. Attorney for the Southern District.

"Wachovia's blatant disregard for our banking laws gave international cocaine cartels a virtual carte blanche to finance their operations," Sloman said at a meeting in downtown Miami. "[They] laundered at least $110 million in drug proceeds."

The feds built a case against Wachovia around the bank's relationship with Mexican exchange banks called CDCs (or casas de cambio).

Wachovia execs knew as early as 1996 that the Mexican CDCs were hot spots for drug money but kept doing business with them anyway, Sloman says.

The American bank routed billions of dollars in the past ten years through the CDCs without any effective oversight into where the cash was coming from.

Prosecutors were able to trace some of that money to the purchase of several airplanes used in drug runs, which led to more than 20,000 kilos of cocaine being seized by investigators.

Under an agreement signed by federal Judge Joan Leonard this afternoon, Wachovia will forfeit $110 million in illegal proceeds from drug sales and pay an additional $50 million fine.

A potentially more important development slipped by with less notice, Bloomberg Markets reports in its April issue. Representative Darrell Issa, the ranking Republican on the House Committee on Oversight and Government Reform, placed into the hearing record a five-page document itemizing the mortgage securities on which banks such as Goldman Sachs Group Inc. and Societe Generale SA had bought $62.1 billion in credit-default swaps from AIG.

These were the deals that pushed the insurer to the brink of insolvency -- and were eventually paid in full at taxpayer expense. The New York Fed, which secretly engineered the bailout, prevented the full publication of the document for more than a year, even when AIG wanted it released.

That lack of disclosure shows how the government has obstructed a proper accounting of what went wrong in the financial crisis, author and former investment banker William Cohan says. 'This secrecy is one more example of how the whole bailout has been done in such a slithering manner,' says Cohan, who wrote “House of Cards” (Doubleday, 2009), about the unraveling of Bear Stearns Cos. 'There’s been no accountability.'

The public can now see for the first time how poorly the securities performed, with losses exceeding 75 percent of their notional value in some cases. Compounding this, the document and Bloomberg data demonstrate that the banks that bought the swaps from AIG are mostly the same firms that underwrote the CDOs in the first place. "

This letter is to formally request that you prepare to take the appropriate legal action against the federal government in the event HR 3200 passes into law. We request this action in order to grant Tennessee relief from the unfunded mandate contained in the bill requiring Tennessee to comply with the expansion of the federal Medicaid program.

Under this bill, Tennessee would be forced to expand our Medicaid program, potentially costing the citizens of this state $1.4 billion dollars in additional state taxpayer funds annually. Such an increase would place a great burden on the citizens of this state. It is clear by the wording of the legislation itself that not every state would face a similar and equal burden.

We see this as a violation of equal protection of the law, an affront to our sovereignty, and a breach of the U.S. Constitution.

Lawmakers File "Freedom of Healthcare Choice Act"

OKLAHOMA CITY - The voters of Oklahoma will have the opportunity to preserve
the existing health care system in Oklahoma under legislation sought by
three state legislators.

State Reps. Mike Ritze and Mike Reynolds and state Sen. Randy Brogdon
announced today that they will file legislation enacting the "Freedom of
Healthcare Choice Act," allowing voters to preserve the existing healthcare
system in Oklahoma regardless of congressional action at the federal level.

The legislation will allow a vote of the people to opt out of the proposed
federal system.
"It's clear the overwhelming majority of Americans want the current
doctor-patient relationship preserved instead of having Washington
bureaucrats dictate medical decisions," said Ritze, a Broken Arrow
Republican who is also a board-certified family practice physician and
surgeon. "The proposals under consideration in Congress are likely to result
in reduced access to a family doctor, rationing of services, or even
outright denial of care if a pencil-pusher decides it is not a 'best
practice.' My legislation would give the voters the ability to protect and
preserve their existing health care coverage."

"The United States' health care system is the envy of the world and the
people of Oklahoma should have the opportunity to maintain the top-notch
care they have received while also avoiding the onerous burdens the proposed
federal law would impose on working families," said Reynolds, R-Oklahoma
City.
"The proposed legislation in Washington is a massive overstepping of the
bounds placed on Congress by our U.S. Constitution," said Brogdon, R-Owasso.
"It is time that we the people tell Congress enough is enough - and now
Oklahomans will have the opportunity to do so."

Modeled on an Arizona proposal, Ritze and Reynolds' legislation would place
language on the ballot to amend the Oklahoma Constitution to declare what
types of health care systems could lawfully exist in the state.

The proposed constitutional amendment would:

* Prohibit any law or rule from directly or indirectly compelling any person
or employer to participate in any health care system;
* Allow any person or employer to pay directly for lawful health care
services without paying any penalties or fines;
* Permit a health care provider to provide directly purchased lawful health
services without paying any penalties or fines; and
* Stipulate that subject to reasonable and necessary rules that do not
substantially limit a person's options, the purchase or sale of private
health insurance will not be prohibited.

The amendment would not change what health care services a provider is
required to perform or what health care services are permitted by law.

"This is an issue that could have serious consequences for all citizens and
it is only right to allow voters a direct role in the outcome of this
debate," Ritze said.

"I was not surprised that the Democrat-controlled U.S. Senate kept the
specific language of their bill from the public and most of their members,"
Reynolds said. "In comparison, the language of our "Freedom of Healthcare
Choice Act" will be fully disclosed as soon as it is filed, probably later
this afternoon. We welcome any discussion."

The project, called the Charged Aerosol Release Experiment (CARE)…"This is really essentially at the boundary of space," said Wayne Scales, a scientist at Virginia Tech who will…study the physics of the artificial dust cloud as it's released…CARE is slated to launch Tuesday between 7:30 and 7:57 p.m. EDT (2330 and 2357 GMT) from NASA's Wallops Flight Facility in Virginia….”

'…CARE will release its (aluminum oxide) (2), dust particles a bit higher than that, then let them settle back down to a lower altitude.”What the CARE experiment hopes to do is to create an artificial dust layer,” Professor Scales told SPACE.com. City of New York Concedes 9/11 Coalition Has 30,000 Valid Signatures To Put Referendum For 9/11 Investigation on November Ballot

New York – In a last minute decision, lawyers for the City of New York have conceded that the New York City Coalition for Accountability Now (NYC CAN), a group comprising 9/11 family members, first responders and survivors, indeed did submit over 30,000 valid signatures to put the referendum for a new 9/11 investigation before the voters of New York City this November.

In an earlier letter from the City Clerk dated July 24, 2009, the City had claimed only 26,003 signatures were valid, 3,997 short of the requisite 30,000. The City’s concession that over 30,000 of the 52,000 signatures submitted were in fact valid paves the way for lawyers from both sides to argue the legality of petition.

Asked whether he thought NYC CAN could overcome the City’s challenge to the legality of the petition, legal counsel to the petitioners, Dennis McMahon, said, “Absolutely. Although the City has an incredibly successful record of shooting down ballot initiatives, we will be arguing from a fresh perspective that reflects the unprecedented events of 9/11. We believe the courts will see how critical an issue this is, and be persuaded with our legal reasoning and point of view.” A final determination on the legality of the petition will be reached in time for the referendum to be included on the November ballot should the petitioners prevail.

Representatives for NYC CAN, 9/11 family member Manny Badillo and Executive Director Ted Walter, arrived at the Board of Elections on the morning of Wednesday, September 9, to assist the court-appointed referee in commencing a line-by-line review of the disputed signatures, only to learn the referee’s review had been called off due to a last minute concession by the City. Mr. Badillo immediately got on the phone to inform others of the news.

“The City conceded we have 30,000 valid signatures. Big victory.”

The City’s concession comes as a result of the immense effort put forth by 50+ volunteers who gave more than 1,000 hours over a two week period from August 10 to August 25 to identify a total of 7,166 signatures that were wrongly invalidated by the NYC City Clerk and Board of Elections. On August 27, NYC CAN filed the 631-page Bill of Particulars cataloguing each of the 7,166 signatures it contended were in fact valid. NYC CAN submitted another 28,000 signatures on September 4 to guarantee the referendum will go on the ballot if they win the court case, bringing the total signatures submitted to 80,000.

NYC CAN must deliver its memorandum of law in response to the City’s motion for summary judgment by Monday, September 21. The City will be given an opportunity to reply before the referee’s decision is made on Monday September 28. Fast-track appeals will likely follow no matter who wins. A final decision will have to be made by September 30.

If the referendum passes in November, it would lead to the creation of a local, independent commission with subpoena power that would be tasked with comprehensively reinvestigating the attacks.

"The FSA study also failed to include the results of a major European Union-funded study involving 31 research and university institutes and the publication, so far, of more than 100 scientific papers, which ended in April this year. According to the Soil Association, the European Union research program concluded that:
• Levels of a range of nutritionally desirable compounds (e.g. antioxidants, vitamins, glycosinolates) were shown to be higher in organic crops;
• Levels of nutritionally undesirable compounds (e.g. mycotoxins, glycoalkaloids, Cadmium and Nickel) were shown to be lower in organic crops; and,
• Levels of fatty acids, such as CLA and omega 3 were between 10 - 60% higher in organic milk and dairy products, and levels of Vitamin C were up to 90% higher in leafy vegetables and fruits.

A response by The Organic Center (TOC) states that the study, “also ignored the 15 relevant studies that have come out since their February 2008 cut off date that could have changed the outcome of the report. In addition, the FSA analysis actually found that organic food contains more phosphorus, a beneficial nutrient, while conventional food on average contains more nitrogen, which scientists have linked to cancer.

Another failure of the study is that it did not include a review of the content of contaminants or chemical residues in foods, which makes organic products superior in quality. "
